1. General Provisions

These Terms and Conditions set out the terms under which planting design, planting consultancy and horticultural advisory services are provided by:

Viktoria Gal trading as PlantaeNet
(hereinafter referred to as the Service Provider).
The person or organisation purchasing or commissioning services from the Service

Provider is hereinafter referred to as the Client.

These Terms and Conditions apply to planting plans, bespoke plant lists, professional planting advice, online consultations and any other services agreed between the Service Provider and the Client.

2. Services Provided

The Service Provider provides specialist planting design and consultancy services, including:

  • Online planting consultancy sessions
  • Bespoke plant lists (ornamental plants and rose-focused selections)
  • Full planting plans and planting schemes
  • Specialist rose advice and rose-related services

The majority of services are delivered online. UK-based projects requiring specialist on-site input may be arranged separately by prior agreement.

3. Service Agreement and Contract Formation

A written service agreement, project confirmation or quotation will be provided before the commencement of each project.

By confirming a booking, accepting a quotation or making payment for a service, the Client agrees to these Terms and Conditions and the agreed project details.

4. Free Introductory Call

An optional free introductory call may be available to discuss project requirements and determine the most suitable service.

The introductory call is intended only to understand the Client’s requirements and is not a design consultation.

No professional recommendations, detailed planting advice or design deliverables are provided during the introductory call.

Following the call, the Client may choose to proceed with a paid service or request a tailored quotation.

5. Quotations and Acceptance

Each project is assessed individually, and a tailored quotation is prepared according to the scope of work, complexity and requirements.

Work will commence once the quotation has been accepted and any required payment has been received.

6. Fees and Payment

Online consultancy sessions are booked and paid for in advance at the applicable hourly rate.

Bespoke plant lists and planting plans are quoted individually according to project requirements.

A deposit may be required before project commencement.

The remaining balance is payable upon completion of the agreed work and before final delivery of completed documents.

Fees do not include plants, materials, installation, delivery costs, travel expenses or accommodation unless specifically agreed.

7. Client Responsibilities

Planting recommendations and designs are prepared based on information supplied by the Client.

The Client is responsible for providing accurate, complete and up-to-date information regarding:

  • garden dimensions,
  • photographs of the site,
  • light conditions,
  • soil conditions,
  • existing planting,
  • project aims and preferences.

The Client is responsible for ensuring that measurements, photographs and site information provided to the Service Provider are accurate and current.

Unless specifically agreed as an additional service, the Service Provider does not undertake structural surveys, soil testing or detailed site investigations.

The Service Provider cannot be held responsible for limitations, inaccuracies or unsuitable recommendations resulting from incomplete, incorrect or outdated information provided by the Client.

Failure to provide required information in a timely manner may affect project timescales, scope of work or the accuracy of recommendations.

8. Delivery and Timescales

Estimated delivery times are provided at the beginning of each project.

Completion times depend on project complexity and the timely receipt of all required information.

Delays caused by missing information, delayed responses or requested changes may affect delivery dates.

Digital documents are provided via email unless otherwise agreed.

9. Plant Availability and Recommendations

Plant recommendations are based on suitable species and varieties available from reputable suppliers at the time of design.

Plant availability may vary according to season, location and supplier stock.

Alternative recommendations may be provided where necessary.

The Client acknowledges that final plant selection and availability may be affected by external factors beyond the Service Provider’s control.

10. Revisions

Bespoke plant lists and planting plans include a reasonable number of revisions as agreed within the project scope.

Additional revisions or significant changes requested after approval may be subject to an additional charge.

11. Intellectual Property

All designs, drawings, documents, plant lists and written recommendations created by the Service Provider remain the intellectual property of Viktoria Gal, trading as PlantaeNet, unless otherwise stated.

The Client receives permission to use the delivered materials solely for the agreed garden project.

Materials may not be copied, redistributed, resold, modified for commercial use or used for other projects without prior written permission.

12. Liability

Planting recommendations are based on professional knowledge and information provided by the Client.

Plant growth and establishment depend on factors outside the Service Provider’s control, including weather conditions, soil conditions, planting methods, watering, maintenance and ongoing care.

The Service Provider cannot guarantee the survival, performance or exact development of individual plants.

Successful establishment depends on correct planting, soil preparation, watering, maintenance and appropriate ongoing care after installation.

The Service Provider’s liability is limited to the value of the service provided.

13. Cancellation and Refunds

Consultancy bookings cancelled before the agreed appointment time may be rescheduled subject to availability.

Deposits paid for design work are non-refundable once work has commenced.

Cancellation requests must be submitted in writing by email.

14. UK-Based Professional Projects and On-Site Support

The Service Provider primarily provides online planting design and consultancy services.

Selected UK-based projects requiring specialist on-site involvement may be arranged separately by prior agreement.

These may include:

  • specialist planting consultations,
  • rose-related projects,
  • support for selected planting schemes,
  • professional collaboration with gardens, organisations, landscape professionals or private clients.

Travel, accommodation and professional fees will be agreed separately before any on-site work begins.

15. Website Use

Website content is provided for personal, non-commercial use.

Users must not reproduce, distribute or commercially exploit website materials without prior written permission.

16. Changes to These Terms and Conditions

The Service Provider reserves the right to update these Terms and Conditions when necessary.

Changes become effective when published on the website.
